Provo Child Abuse Suspect Arrested Again

Man accused of leaving young daughter out in the cold is again booked into the Utah County Jail.

A Provo man arrested in December for allegedly leaving his four-year-old daughter out in the cold is back in jail on new charges.

Richard Anthony Kelly, 37, had bailed out of the Utah County Jail following his December 8, 2009 arrest on suspicion of felony child abuse, driving under the influence and other counts.  On Thursday, he was arrested again by Provo sex crimes detectives.

"We had a warrant of arrest for him," said Provo Police Cpt. Cliff Argyle. "We were unable to locate him to talk to him about a case - an ongoing investigation - and that warrant for his arrest was for rape of a child and sodomy of a child."

Kelly remains in jail while police conclude their investigation and present the facts of this new case to the Utah County Attorney's Office.

"They're aware of the case," said Argyle.

In the December incident, a pair of passers-by spotted the young girl crying while standing in her pajamas amidst the snow.  They called police, who took custody of the child in the area 400 South University Avenue. Officers then went to Kelly's nearby apartment and reportedly found the child's mother, 23-year-old Amber Palmer, passed out on a couch.  An 18-month-old boy was also inside. As police were speaking with the woman, Kelly is said to have returned home, intoxicated.

Both parents were arrested. The four-year-old girl and her 18-month-old brother were placed in the care of the Utah Division of Child and Family Services.
